Privacy Policy


Xtensible Solutions, Inc. (“Xtensible,” “we,” “our,” “us”) owns and operates the CIM EA Web site.  This Privacy Policy (this “Policy”) applies to the CIM EA Web site and governs data collection and usage.  By using the CIM EA website, you consent to the data practices described in this statement.

Changes to this Policy

We will occasionally update this Policy to reflect company and customer feedback as well as changes in the law.  Accordingly, we reserve the right to update or modify this Policy at any time, without prior notice, by posting the revised version of this Policy behind the link marked “Privacy Policy” at the bottom of each page of the CIM EA Web site.  Your continued use of the CIM EA Web site after we have posted the revised Policy constitutes your agreement to be bound by the revised Policy.  However, we will honor the terms that were in effect when we gathered data from you.  We encourage you to periodically review this Policy to be informed of how we are using and protecting your information.

Other Agreements

We may also require you to follow additional terms, rules, guidelines or other conditions to sign up to use various special features or password-protected areas of the CIM EA Web Site, to obtain access to certain software or other products made available on the CIM EA Web site, or for other reasons. In such cases, you may be asked to expressly consent to these additional terms, for example, by checking a box or clicking on a button marked “I agree.” This type of agreement is known as a “click-through” agreement. Collection of your Personal Information

We collect personally identifiable information that you knowingly and voluntarily provide when you use the CIM EA Web site, such as your e-mail address and name.  We may also collect anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests and favorites.

There is also information about your computer hardware and software that is automatically sent to us by your web browser.  This information can include: your IP address, browser type, domain names, access times and referring Web site addresses. This information is used by us for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the CIM EA Web site.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through public message boards, including those on the CIM EA Web site, this information may be collected and used by others.  It is possible that another subscriber will distribute such content to the general public, for example, by posting it on another Web site.  Therefore, you should have no expectation of privacy with respect to the content you or others submit on or through the CIM EA Web site.  You should not submit any content you do not wish to make available to the general public, and you must take special care to make sure your submissions comply with our Terms of Use.  In particular, your submissions must not violate the privacy or other rights of others.

Use of your Personal Information

We collect and use your personal information to operate the CIM EA Web site and deliver the services you have requested.  We also use your personally identifiable information to inform you of other products or services available from Xtensible and its affiliates.  We may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

We do not sell, rent or lease our customer lists to third parties.  We may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you.  In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party.  In addition, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries.  All such third parties are prohibited from using your personal information except to provide these services to us, and they are required to maintain the confidentiality of your information.

We do not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

We keep track of the Web sites and pages our customers visit within the CIM EA Web site, in order to determine what services and features are the most popular.  This data is used to deliver customized content and advertising within the CIM EA Web site to customers whose behavior indicates that they are interested in a particular subject area.

We will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us or the CIM EA Web site; (b) protect and defend the rights or property of Xtensible; and, (c) act under exigent circumstances to protect the personal safety of users of the CIM EA Web site, or the public.

The CIM EA Web site may provide links to other Web sites operated by third parties.  Because we have no control over third-party Web sites, we are not responsible for the availability of those Web sites and do not endorse and are not responsible or liable for any content, advertising, services, products, or other materials on or available from such Web sites.  We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, advertising, services, products, or other materials on or available from such Web sites.  This Policy does not apply to your use of third-party Web sites; your use of such Web sites is subject to the terms and policies of the owner of such Web sites.

Information for Visitors Accessing Our Sites from Outside the United States

Xtensible is a U.S. corporation headquartered in the United States.  The CIM EA Web site is currently hosted on servers located in the United States, although we reserve the right to relocate the CIM EA Web site to other servers elsewhere in the world.  Your personal information may be stored on servers located within the United States or in another country.  In addition, we may transfer your personal information to our service providers and others located in the United States or another country for the purposes described in this Policy.  Different countries have different privacy laws and requirements, and some provide less legal protection for your personal information than others.  Please know, however, that no matter where your personal information is collected, used, transferred or stored, if it was collected through this Policy, it will be protected by the terms of this Policy and any other agreements that apply to you.


BY USING THE CIM EA WEB SITE, YOU ARE CONSENTING TO THE COLLECTION, USE, AND TRANSFER OF YOUR PERSONAL INFORMATION IN OR TO THE UNITED STATES OR TO ANY OTHER COUNTRY IN THE WORLD SUBJECT TO THE TERMS OF THIS POLICY.
